In December my small office hired an established sales rep who had their own contact sphere to get commercial accounts for our office, which is primarily residential. She set up one subagency (three year exclusive contract with us) and was in the process of developing three other large exclusive subagency accounts, including two bank systems, when we decided she was too independent and not fitting into our office. She did not bring in the daily orders that the other reps did. She alleged that it was our lack of computer or office space and lack of private Voice Mail for her that forced her to set up a telecommute office at home and buy a business PC and software (MS Office) out of her pocket. But we've had other reps share desks and it worked for them.

She has called two of the accounts she had been working on signing when terminated to ask if they signed and whether they were told she was no longer with us when they did. What rights does she have to contact them if she is not with us? Or to claim the three years of commission for establishing the subagency - as she is no longer here to service the account? I only now discovered that her brother is on the board of one of the two banks that we signed right after she was terminated.
