I'll try to keep this brief:
A family member of mine is highly compensated over 40, white, female and has been employed by a large fortune 500 company for the past 6 years. All reviews until the past 1 1/2 years have exceeded expectations.
During the past year a new boss came in and personality conflicts have developed. Last years review came in below expectations with the only action is to take a stress management class (has been done). The new review came in today and also was below expectations with no reasons stated. The company wants to demote her to a supervisor with the same pay. No work performance issues have been provided. I should also mention that management was aware she was seeking mental health benefits due to a death in the family a year ago. They are trying to make the situation difficult for her to leave.
Is this legal and if not what are the courses of action? Is there any age discrimination or ADA?
