Can an employer fire an employee for a misdeameanor conviction? When I was hired, I didn't have a record. That was 5 years ago. I've recently been charged and convicted (2/2005). My case was stalled for 5 years until recently. Will my job find out if they've already done a background check?

Can they fire you? Yes.

Will they find out? Requires a crystal ball.

Don't be so sure, either one of you.

Has it not occurred to either of you that this information is public record?
