My employer pays me a min. of 35 per week whether I complete 35 hours or not. Howver, last week he gave me a day off in order to avoid paying overtime. Is this a violation of FLSA or any state laws? I am employed in Fla.

I don't follow you. If you got a day off, then you didn't work during that time. Thus, you didn't work over 35 hours in that week. Thus, you were not entitled to overtime per the FLSA. Right?

If this is correct, then what is the employment violation?
