On June 12, my San Diego, California employer laid off 10 persons including myself. In the exit interview, all were given both consideration (final checks) and severance pay (based on time worked), except for me. I received my final check, but because I was the only one in the group over 40, my severance pay is being held for 5 business days after signing the agreement.
I signed the separation agreement and returned it to them.
OWBPA says the employer must give employee 21 days to sign the separation agreement, and 7 days to revoke that agreement. Five business days = 7 days. If I revoke the agreement, I believe I will forfeit the severance pay.
Is something here irregular?
