Maine - At the beginning of the year, a co-worker was demoted from a management position. They cut his pay by .75 cents an hour. When he asked why, they said because he had too much in his personnel file. He then proceded to ask for a copy of the file. They refused to show him the file or give him a copy. Is it legal for them to demote him because of his personnel file and then refuse to show it to him?

It is legal for them to demote him; however, the state of Maine does require that they show him his personnel file upon request. I do not have any employees in Maine so there may be some logistics that I'm not aware of; for example, some states require that requests be made in writing. He should contact the ME DOL for advice on how to proceed.
