What is the name of your state (only U.S. law)? California

Bob applies for a job but is not considered a candidate because he is told that they prefer
a candidate from outside of his organisation and company rather than someone from within his
organisation. This preference for someone from the outside is not stated or declared in the job description.

is this discrimination ?

Based purely on the few lines you've written, this is not illegal discrimination.

yes, it is discrimination but it is not illegal discrimination. Discrimination in itself is not illegal. In fact, most discrimination is in fact legal. There is a very small and specific group of issues that it is illegal to use as the basis of discrimination. Among them are race, color, religion, sex (including pregnancy), national origin, age (40 or older), disability or genetic information. There are a few other protected classes in certain states or municipalities.

I have two followup questions:

1. in lieu of using the term 'discimination', could it be called 'not allowing equal opportunity' ?

2. is 'legal discrimination' considered an ethics issue ?

1. It is not allowing equal opportunity for current employees. Perfectly legal.

2. Legal discrimination has nothing to do with ethics. It is called exercising choice.
