On 7/7/05 My husband Larry got sick w/cramps He went to the Co nurses She asked Larry if he needed to go to the Drs office He said yes he did but he was scared to drive himself she said she would drive him to the drs office Little later Nurse said that she would NOT be taking him to the Dr office and that Larry should just drink more fluids That night I took him to the ER Dr at the ER said Kidneys were starting to shut down and he had ARF due to dehydration He had to stay in the hosp till 7/9 Dr had release him to go back to work on 7/16 Co HR said the paper work was not enough and Larry needed to get FMLA paper filed Co dr release Larry to go back to work 7/13 HR set up another appt w/ Co Dr Co dr did not agree w/ ER Dr, so Co set up a 3rd appt w/ another dr for 8/19 The 3rd Dr did agree w/ the 1st doctor. WC co has excepted the claim and Larry has already been paid by our ins through temp disability It has been 4 wks since the 3rd dr appt and has not been asked to come back to work even though all 3 drs have released him He just now rec'd a letter on 9/17 saying he is terminated eff 8/14 How can Co. fire him before the 3rd dr appt? How can co. wait so long before sending him the termination. Do we have a case?
