drugtests@healthclinics:could clinic lawfully inform company of suspicious behaviors?

If a company sends an employee to the health clinic for a drug test, can the health clinic inform the company of suspicious behavior on the employee's part while employee took drug test? For instance, employee was nervous, antsy, acting suspicious, drank large quantities of water, etc. while going through the process to take the drug test?

Are there laws/policies/procedures that prevent health clinics from informing that type of information? Or is the health clinic ONLY allowed to advise of the test results themselves and nothing else? Thanks in advance!

Of course they can. After all, the 'company' is their customer.

No.

thanks for the quick response. First thing that comes to mind is "duh!" What complicated it for me was mixing it up with the laws and liability issues of references/past employers & new hires

The employee's behavior during the testing process IS a part of the testing process and the clinic is may most certainly report what they observed to the employer.

HOWEVER - the testing center is not under any duty beyond the basic urinalysis / drug screen panel, unless the contract specifies otherwise, which would be uncommon. Do you realize how many people get tested?
