My 40 hour a week employee wants to doing contract work on the side, as a contractor.

I told her if she had a D.B.A. and General libility insurance, then maybe so.

Question:
Can an employee be a contractor too for the same company?

*** Yes, but it is NOT recommended. Simply, there will at some point be a conflict as to which 'hat' the person was wearing at the time.
Further, if a complaint is filed with the state Workforce Commission , they could decide that the contractor status was simply a method to avoid overtime or compensation.
