What is the name of your state? NJ

My spouse and I own a small business in New Jersey. Our employee handles a route in New York. He also lives in New York.

He has not reported to work in 2 days, now and has not called. Can we fire him for job abandonment?

Absolutely, as long as he is not operating under a bona fide contract that says otherwise.

The law does not specify what constitutes job abandonment. Most companies I know of use either two or three days, so you should be fine.
