Employee rights


I was working in Pasadena, California. My employer offered me by a written contract health insurance and 401K. I worked 7 months with the company and they never gave these benefits. Also, the last checks didn't have the tax stub, but the taxes were deduced.
Also, another employee discovered that the company was paying only 4 weeks salaries, even if the month had 5 weeks.
What is the best thing to do with all this irregularities?

These are issues to take up with the State DOL.

Was it an actual contract, or an offer letter?

For your friend--I don't know if this helps, but...

For my monthly-paid employees, the monthly salary is the same each month regardless of days (or weeks) in the month. (Yearly salary divided by 12 and taxed over 4.33 weeks--equals 51.96 weeks) That way, you get paid the same whether it's a tiny month like February or one of the 31-day-no-holiday months.

And, if you're salaried, look at it this way--There's an average of 22 work days in a month. If you're fighting for that extra 23rd day, you should be willing to take the cut for 19-20 work days in February.
