This is in the state of TN. If an employee resigns or is fired, can the employer give out information about why an employee left a company to a future employer? If the employer gives out the information, what recourse does the employee have against the ex-employer.

Employer giving out info

Yes, the employer can give out info about why the employee left; however, if the info is false, the employee can sue for defamation.

I am not so sure about the above response. I was an HR Manager in TN and was told by our legal council that only dates of employment, position, full or part time status, and if the employee was eligible for rehire should be answered. If an potential employer gets your signature, though, they can use that to gain additional knowledge. Meaning, you have to give consent for reference checks which include above and beyond!
