What is the name of your state? CA

I got hired on H1 status 2 months back and my employer refuses to give me even a copy of the document. Is it his legal right to have the document? What steps do i take to get the I797 approval notice?

Since it's been a couple of years since I sponsored anyone for an H1B visa (ironically, the last one was approved on 9-10-01) I can't recall which forms the employer was legally required to give you. However, I'm about 98% certain that you can apply for a duplicate I-797 through the INS, or whatever they're calling themselves now. You might want to check their website.
