What is the name of your state? PA

My wife recently signed an employment contract with a company based in VA. One of the clauses of the contract is that she should not leave the company untill Dec 25th, 2004. Is this a legal clause?

I doubt very seriously that this is the complete clause you want referenced.

What does this stipulated minimum date REFER to? Such clauses are perfectly legal in regards to monies forwarded, training expenses incurred and the such.

So, come back with more information.

thanks for your quick reply. No it does not refer to non-compete clause which is there in the contract and we dont have a problem with that. Some more details:

1. Offer letter says she is appointed at such and such level and can leave the company by giving two-weeks notice.

2. An addendum to the offer letter says that she cannot leave for one year and that in case she leaves she will be liable for liquidated damages.

Do let me know if you need any other info. And no training or probation or any such thing is involved. it is just that she cannot leave employment before a specified date.

In other words, they are paying relocation and don't want to get stuck with someone who comes for six months.

This is not what it means. It means that if she does leave within the first year, she is liable for the cost to bring her to the place of employment, and for any other costs incurred by the company.

It does not mean she is stuck there.

nope they are not paying relocation. relocation is at our expense.

Then there are other training or such expenses that they are incurring....

Best to write or call them and have them spell it out what exactly they mean by this clause.
