I had emergency back surgery, my surgeon cannot give a release date at this time. I will go over my FMLA. My job will most likely terminate me. If they do, once the doctor releases me to work can I file for unemployment?

Actually, you should file and establish a claim as soon as you are terminated. That will establish your look-back period with the highest wages since you don't want to a quarter where you were working fall off and be replaced by a quarter where you didn't work or didn't work as much. Once you are released from work you can start to look for a job and claim benefits.
