Is there a state agency that monitors companies that do personal background checks.What guidelines do they comply with . What are the liabilities on the information they produce.I guess i mean "who do they answer to if they have cost you your livelyhood if you have proof that the info is false or out of date?"What penalties can they expect if you pursue legal action and its found that they did not follow the guidelines to run the check?

Depends - what kind of "background" check? Are we talking criminal, rental, credit, etc.? There is a difference between a background check being done by a law enforcement agency or one of those so-called things on the internet that claims to do it for you.
