I encountered a situation in which my boss acted against current company (Autonation) Human Resources (HR) policy. The company has a strong HR policy according to how it is written. I filed an HR complaint on 08/21/09 and stopped going to work with my reasons explained in the complaint. The HR specialist advised me that I had to go to work even with a complaint in which I described that I felt in a hostile environment after an intimidating threat by my superior. I requested to get transfer to another store. The company has more than 30 stores in the area. However, the HR specialist insisted that I have to show up to work if I wanted a transfer. After only 4 days and with no further inquiry and/or investigation on the matter, the HR specialist advised me that I will be terminated for not going to work.

What can I do?

Thank you for your reply. However, I guess my point here is that if in my complaint I clearly stated feeling in a hostile environment after an intimidating threat then:

Doesn't HR has an obligation to investigate the incident?

Is it ok to fire an employee for not showing up even with a complaint stating such conditions at work?

I am just trying to get an idea of where do I stand as far as any legal rights on this issues.

Even if your complaint was regarding a valid title 7 discrimination complaint, you don't have the right to tell the company HOW to investigate it, or to refuse to work until it is investigated to YOUR liking.
