I gave notice 10/29/00 that I would be quitting my
bartending job on 12/16/00 because the business was relocating.
I was assured by the manager that I would be allowed
to work out my notice since it was right before Xmas.
Apparently, the owner, finding my notice, (and
immediately following an argument outside of work with
one of his "friends" - 40 miles from business location)
told the other manager to call me and fire me. Their
explanation was that it is company policy. There is
no written policy and every person employed there for
the three years I have been there has either been fired
or worked out a notice.
That was my only job and won't start a new job until
after the first of the year. I have two children and
three stepchildren to provide Xmas for. The money I would
have made would have been their Xmas.
I have NEVER been disciplined or had any negative
problems since my employment began 2/98. Are there any
remedies for me?

If you give notice to quit on a certain date, they fire you without cause before that. They owe you, your hourly rate till that date of departure. I would think that you should get a average day tips as well, but I would wait till someone who knows the law better to reply. GOOD LUCK!

Was your notice written? and if so did you get a copy? They are probably trying to fire you so that you cannot claim unemployment against them. Did they give you a reason for the termination? In some states they do not have to. It does sound like unfair business practice, but I am not a lawyer. Most attorneys allow for a free initial consultation. I would contact a local attorney that specializes in termination cases. The money may not make it in time for Christmas, but I think that you would get it.
