What is the name of your state?

Oklahoma

Recently I was fired for theft, no charges or anything were filed with the police. My former employer is now withholding my last two paychecks and some commission that was due to me as well. Can he legally keep that money? Also after being fired as I was can he file any kind of charges later on down the road or would they have had to been filed then??

Can he legally keep that money? Nope. Oklahoma reg's require that a terminated employee receive his/her final wages no later than the next regular pay day. Your employer cannot hold your paycheck hostage even if you owe him money for stealing.

Also after being fired as I was can he file any kind of charges later on down the road or would they have had to been filed then?? The employer can file a police complaint anytime during the length of time allowed in the statute of limitations for whatever crime they allege you committed.
