I was fired today by my employer who came into my office and said "you have one of two choice's, you can either tell us what you know, or you can be escorted out of the building." I told them that I had been asked by a superior to read a document which I later found out was illegaly obtained. After I told the president and general manager what I knew, they still fired me. The president asked to see my personal cell phone to make sure that I was not stealing any of the company's customer's phone numbers. When they asked me to leave they refused to give my phone back to me claiming the police were on their way and they would need it to check my phone logs. No police were present at this time. In addition, I was not allowed to take any of my personal possesions with me, they assured me that i could have them back at a later date.
Have I been unjustly fired, and do I have a right to obtain my personal possesions from my office? Please help!!!!

We're going to need a few more details - what do you mean when you say the document was illegally obtained? What did you do when you found out how the document was obtained? What kind of document was it?

As for your possessions, type up a list of everything and forward it to the HR manager with a note stating that you will be coming by in X days to pick up your property, and if it not available you will be taking whatever legal action necessary.

The document I am referring to was a print-out from the company's accounting program showing that no commisions were paid to the person who illegally obtained this information. My associate did not have authority to be in this system. He handed me this paper and said "read this," which I did. I did not comment on it, but I did remain in the room where conversation took place about the credibility of the company we worked for. I did not interject anything into the conversation, however. Am I gulity by association, and if criminal charges are fired, could I be in jeopardy????

One of the items that the company president took from me was my personal cellular phone. she said she needed to give it to the police as a part of the investigation. When I contacted the police yesterday evening about geeting my phone back, they were unaware that she took it and still had possesion of it. Does this sound like ethical and moral business behavior? What rights do I have in this situation????

Maybe it's just me but I still don't see what illegal act you're referring to. An employee who was not authorized to do so improperly accessed a company record. That's a company policy issue, not a police matter.

I don't get it. :confused:

Okay, so basically someone violated company policy, and you privy to the fact that they did so, and the following conversation. You did not report the violation to the appropriate authority in the company. The company verified that you knew about the violation, and terminated you.

No laws have been broken, and there will be no criminal investigation.

Send a letter, certified, return receipt requested, to whichever monkey is in charge of the zoo telling them that they have 15 days to return your personal property or you will be forced to report the theft to the police. Or, skip the letter and call the police.
