In August of this year my wife went through a staffing agency to find employment. Due to migranes, and are daughter became ill while working there she missed some days. The employee repeadetly told her that she would be able to saty. My wife had a doctors note every time. Recently she came down with strep throat and with doctors orders was told she could not return for another day. My wife caleed the employer who told her to get better and they would see her the next day. My wife recieved a phone call from the agency just hours later fro the staffing agency stating that sh was let go from her duties. The reasons beeing that she has missed days from work. Then informed her that they had already replaced her a day prior but, never let on that they were letting her go.

I was just wanting to know if ths is legal in the state of Arkansas? And if not what can we do?

Don't know Arkansas Law but it is the case in almost every state that absent a contract or a union you are an at will employee.

While you can not be terminated for anything that smacks of illegal discrimination -- race, color, creed, sex, age, etc. -- I doubt that she has much grounds. If there is a possible claim it is under the Americans With Disabilities Act.

As a temp hired by Company A who asigned her to work at Company X, if Company X could say they do not want her and that's it, I fear.
