A friend of mine was fired from her job recently. We are from Houston, Texas. Does my friend have a right to collect unemployment? Her job performance was unsatisfactory. There was no misconduct. The employer can specifically prove the poor job performance. She was employed no more than three months. Thank you.

She can file for unemployment as long as she didn't quit her job voluntarily. The real question is will she qualify for unemployment and that can only be determined after application.

Go ahead and file. It doesn't cost anything and the employer may not challenge her filing. However, only having 3 months of work will make for a mighty small check if found qualified.


"To claim unemployment benefits, claimants must first register for work at a state employment office. After registering for work, they may then file an initial claim for unemployment compensation showing the name of the employer for whom they last worked and the reason for their unemployment.
The claimant's registration for work gives the Texas Workforce Commission an opportunity to help the claimant find a job. A notice of the initial claim is mailed to the last employer named on the claim.
Issues arising as a result of statements made on the initial claim or as a result of information received from the employer will cause an investigation to determine a claimant's entitlement to benefits.
After filing an initial claim, claimants may file claim certifications for periods of seven days following the initial claim. The initial claim is not a payable claim. The claim certifications are the basis for making weekly payments of unemployment compensation."
