We have an employee that was hired about 2 weeks ago to work for our software development company. He has been working from home, but has been claiming he has worked more hours that the work he has accomplished shows. We talked to him about this, but it continues to happen. We would like to fire him, however he is an alien with a green card to work in the US. We are concerned about discrimination charges. Is there any documentation that we need to have before we fire him? Any help you could give would be appreciated. Thank you.

Do you have an employee handbook that spells out a "probationary period?" Anyone can file a complaint with the EEOC. Whether it goes any further after they investigate or not depends on whether they find anything that they would consider discrimination. It doesn't sound as if you are discriminating based on race, national origin, etc. I would just tell him that his work was not acceptable and as you were lead to believe it would be.
