My 17 yr old daughter was fired from a job at a dept store for theft of merchandise ($100). She apologized & paid restitution & no charges were filed. Several months later she applied for another job & received a letter that that they could not hire her due to a consumer report they received about her theft. We were told this would be kept confidential. She is a high school student with good grades & has never been in trouble before (that is why no charges were file). We received a copy of the consumer report from a company called Secure Point and it listed all the information & that it was verified internally. It also stated that this information would remain on the national database for 7 years. Is this legal and what can we do? She did on stupid thing at 17 and will not be able to find another job whenever someone does a credit check/consumer report.

It's perfectly legal. Next time, Hopefully there won't be a next time, get any agreement in writing from both parties. Then, if the information is not kept confidential, you may have grounds for a breach of contract suit.

At the present time, your daughter is like thousands of others. She'll have to deal with her past.
