I have an employee who was no FMLA. His 12 weeks ended and he was given notice that the 12 weeks were ending and to provide medial certification to return to work, which he did. He was supposed to return to work and has not yet. I have tried to contact him by phone and the phone is dicounted.

What are my rights as a employer in regards to termination of employment with this employee?

If he has exhausted his 12 weeks of FMLA; has not returned to work and has not contacted you regarding any plans to return to work, you are legally free to terminate his employment.
