my wife's employer has drawn a line in the sand. she took maternity leave under the FMLA after she had exhausted all of her sick and comp time. after delivery, she had to go back and have minor medical surgery extending her time off well beyond the 12 weeks allowable under FMLA. They now say if she does not return to work next monday, they will issue a letter of intent to terminate her. She has not been released back to work by her doctor and the employer is stating it is now out of their hands. Past practice by her employer was to allow people under similar circumstances to exceed the FMLA time limit. It seems that this has become a personal issue with her employer and they have decided to stop at nothing to follow through with what I am interpreting as a wrongful termination. Do we have a case and is this worth involving an attorney?
