My roomate was dismissed from his job as a hairdresser yesterday because the owner of the salon he worked at received a job reference call for him. My roomate wants to know if he is at all eligible for Unemployment Benefits. He was on 100% comission, however, a few weeks ago the owner stated to him (during a discussion about his hours) that technically he had the right to require him to be there 40 hrs per week, regardless of whether or not he had clients. This lead him to believe that he does pay $$ MESC and that he may be eligible for unemployment. Thanks in advance for your assistance

Apply for unemployment. If they turn you down, then you're not eligible. So long as you tell the truth, you don't get in trouble for trying.

The reason your roommate was dismissed won't bar him from receiving UC benefits. The only question is whether he was actually an employee of the salon or whether he just "rented" a chair. If the latter, then he was a contractor and no UC taxes were paid on his salary.

As Some Random Guy said, your friend should apply for UC benefits and see what happens.

By the way, if this prospective employer called your friend's current employer without his permission, your friend ought to give that company a piece of his mind. Nothing illegal transpired but it is extremely bad form to contact an applicant's present employer without clearing it with the employee first in order to avoid what happened to your friend.
