How should I answer this question on a background check?

What is the name of your state (only U.S. law)? Ohio

I meant application, not background check!


"Have you ever been convicted of a criminal act?"

I had an OVI in the state of Ohio.

Ohio codes its violations TR and CR, traffic and criminal.

OVI cases are coded as TR.
Both my lawyer's office and the court clerk told me it was a traffic offense.

However, the terminology that the application (criminal act) worries me.

Don't some background check services list OVI as a criminal offense?

I would answer no. If they do run a check on you and if it comes back as a criminal offense and if they ask you about it you can truthfully say you were going by what your lawyer told you. At that point they could not hire you or fire you but they could do that anyway for almost any other reason.

why dont you just tell them about the OVI? often hire people with things on their background checks but never hire anyone who has lied or gave the appearance of dishonesty on an application.
