Illegal Furlough

What is the name of your state: California?

I have been put on a 4-6 week furlough that is consecutive. I was not given a specific date to return to work. I was told pretty much that I am on standby. I was also told that I could file for unemployment. They owe me around $3.5K in vacation pay which I was told that I cant take or cash in.

I visited the labor board today and I was told that I have a case since I was not given a specific date in which to return to work. Here is some labor law straight of the Division of Labor Standards Enforcement I think applies to my case.

My question is this: Should I frist write a letter to my employer demanding my vacation pay siting the CA labor law, or should I just go on and file a wage claim with the DLSE? The wage claim will take anywhere from 30-45 days.
