inconsistant discipline for same action

i was terminated for using "offensive" language to another employee because the language made him uncomfortable. i was given no warning nor was i ever approached by the employee and told that he was offended. 2 years ago an employee was fired for very similar action but was rehired because he had never been told his actions were offensive. i know in louisiana that you can be fired for any or no reason, but do the policies and procedures not have to be followed in the same manner for all employees?
