Job "cancelled" 3 days before it started

What is the name of your state (only U.S. law)? Florida

Wife Nurse Practitioner and left a large hospital for a work from home job with a large medical insurance company (United Helthcare thank you!). Gave her notice at hospital and was supposed to start new work at home job 4/2/12. Even shipped out all the IT equipment to our home. Hired through through third party recruiter.

Got a freakin email (not even the decency to call) claiming program cancelled and job no longer offered. Signed an employment agreement with salary, benefits, etc. from 3rd party contractor. States "Areotek conditionally offers to employ....commencing 4/2/2012 at its client, United Healthcare, for services with the latter for a temporary period..."

Any recourse? Wasted time with drug test, driving to Areotek facility to sign docs, etc.What is the name of your state (only U.S. law)?

No recourse .. if you wanted expenses paid for then you should have gotten this agreed to before you incurred the expenses.

If you signed an employment contract with this 3rd party contractor, then it is they that you have an issue with. However, you would need to read through the contract to see exactly what the conditions are that might prevent them from fulfilling their end of the contract and whether or not there is any recourse you can seek.

I agree that this 3rd party contractor should have verified the availability of the position they offered prior to extending an offer of employment. However, the fact that their client, the company that you were to perform work for, cancelled the program may not be something they (the 3rd party contractor) had any control over, and there may well be nothing your wife can do about it.

"Conditionally offers to employ" is language rarely (if ever) found in a binding employment contract. With that caveat, the only way to find out what your wife has for sure is to let a licensed attorney review it in its entirety.

States "Areotek conditionally offers to employ "Conditionally" appears to be the key word here. There was no guarantee made to employ your wife.
 
The statement also says "temporary period." I think OP's wife was premature in quitting her job and needs to see if she can get it back.

I have seen this happen many times from recruiters ... the employer says "maybe" & the recruiter says its concrete ...

You may consider a regular case ... aerotek may want this behavior to be not publicly displayed ... send them a demand letter ....

That's the cost of dealing with employment agencies. An agency is not going to worry about the threat of a lawsuit, so don't go down that road.
