my boss changed my schedule after another employee would not show up for his assigned schedule. I explained to him that I could not work weekends. He is willing to let me go for not working the other guys schedule but he,the other employee,can stay with no reprimand. Is this legal? I have had this set schedule since the store opened. My boss left it up to us to decide the schedule,but now he is interfering. (this is in the state of new mexico)

Even if the boss is showing favoritism to the other guy, I don’t think you have had any of your legal rights violated.

If however, you are a member of a protected class, such as racial, national origin, religious, sex, etc., then maybe you could make out a case that there was discrimination.
