Lots of companies delay until severance time hits. In signing a letter for severance usually you have to agree not to sue. Is filing an EEOC complaint considered a suit?

In the severance agreement will probably be the words ". . . before any governmental administrative agency." However, the EEOC is looking into these agreements closely due to the fact that they have/might be[en] signed under duress and/or intimidation. If you have signed one, you must let the EEOC take a look at it when you contact them about filing a Charge. They will let you know if you can proceed.
