Hello.
I was a resident manager for my apartment complex where lodging was included in my paycheck. A little over two weeks ago I gave my two week notice, which expired Friday 10/24. On Monday, 10/27, I gave a written 30-day notice of my intent to vacate the apartment, acknowledging the fact that I would have to pay the final month's rent.
Yesterday I received a letter from my former employer saying that I was not a resident, had never been a resident and therefore have no rights to stay in the apartment. That they want me to vacate the apartment yesterday. They say that they will file a forcible detainer action against me, which would ruin my credit much like an eviction would.
My question is, is this legal? I have lived at my property for a year now; as well as being "paid" lodging for my apartment, the company charges rent to those who take sick days without having sick/vacation leave and while I do not have a written lease, I have been told orally numerous times that I have to follow the House/Rental Agreement laws while living on the property...basically I feel that I am a resident.
Am I or am I not a resident? Do I have rights? Thank you.
