Can an employer make up cause at anytime after termination? Or does a reason have to be given at termination of establish cause? My former employer is refusing to pay my accrued vacation even thought the company's policy manual dictiates that I am paid my accured vacation. Now she is saying that I am not entitled to my vacation pay if I was terminated for cause. She did not give cause at the time of termination and is implying that she did.
I have been given a confidentiality agreement that settles all future claims against the company. This means I would forfeit my vacation pay if I sign it. I need to know if what she is doing is legal, or is she being a bully and assuming that I don't know.
Please help! If anyone has any input, it would greatly help. I have to make my decision by the end of the day.
