Hello I would like some info/help with my appeal for unemployment in Missouri.
I was seperated from 1 of our local Casinos for texting behind the bar. I was A bartender there. It was 1:43am and I has no customers at the bar, I recived a call on my cell and I noticed it was my 16 year old daughter. I did not answer it. (the phone was in A zipper money bag, out of view from everyone except the eye in the sky) then I recived a 911 text from here and then she called again, I picked up my phone and ran to the back of the bar ducked out of view and hit answer, No one was there. I typed whats wrong and then placed the phone back into the bag. Since the phone had the sound turned off I checked it several times, never taking it out of the bag. Finaly she texting me back telling what was wrong. Thats it!! now 11 months and 2 weeks prior I did get A first and final for texting but nothing but Highly successful the rest of the time on all raises and work history. Policy states cell phones and pagers must not be in view of guests. Used in break room. My mrg even said he did not think it was A big deal and I had A good reason for answering the text.

You got a final warning for doing it and you did it anyway. I would not be optimistic about your chances of prevailing on your appeal. If it was a true emergency, your daughter could have called the casino and they could have gotten a hold of you.

I'm surprised they even allow employees to carry personal cell phones on a casino floor. Or maybe they don't.

That is the problem with cell phones and presumably 24 X 7 communications. People think they should be able to get in touch in anyone, anywhere, any time. What did we do before personal cell phones? Oh, we called the employer and said "There is an emergency with Mary's daughter and we need to speak with her as soon as possible." That worked.
