What is the name of your state (only U.S. law)? NY

I am trying to help a student of mine who took the Certified Nurse Aide class and was working as a CNA until her background check came back. She was terminated because of neglect charges in her file from Child Protective Services. She has custody of her children and there is no ongoing involvement with CPS. Is there a way to get the neglect charges dropped so she can get her job back? Her dream is to become a nurse but she can't go on for training in that field with the charges on her record.

Your student should really come and ask the question herself, because the details are important. When was the allegation of neglect? What action or inaction was she accused of? What was the result of the investigation?

Certainly she can understand why a facility charged with caring for patients would be leery of someone who has been accused of neglecting her children.

If it was an Article 10 Family Court neglect finding then no, that's not ever going anywhere. If it was something else, then ... maybe?
