non-compete texas

my husband signed a non-compete agreement as a condition of employement in texas 11 months ago. He has since decided he can no longer can work for this company, the owner is verbally abusive and emotionally unstable and has made our life a nightmare over the last year. He is a project manager for a commercial electrical contracting firm. he has accepted a job for more guaranteed money but less over all with a competing firm in the same town. The non-compete included the four surrounding counties over a period of three years. There is no real legitimate trade secrets the company is protecting, the industry operates on a low bid process which is evaluated per job and monthly, there are no client lists to steal nor was he trained in the field by this company. the company did not invest any money or time in special training. ultimatley the business does not stand to be hurt. my husband will not be a part of the bid process at this new company his only duties will be in the project management area. prior to taking the job 11 months ago he had been with his previous employer for fourteen years. he is very stable and does not job hop. he would have never felt the need to leave if he had been treated professionaly. the non-compete is more of a punitive tactic to lock employees in and allow the owner to treat them in a very unprofessional manner. What are the chances that this will be upheld?

If you are asking about the legality of those contracts, they are common and legal. More often than not they are upheld. Will the employer sue you to enforce it? Only God knows that.
