I am an IT consultant with a non-solitation agreement that says I can't go to work as a permanent employee for my current client. Since my current client is my former employer, does this mean that my current employer has no right to enforce the non-solitation agreement since there is really no competition (they would not have the client if I had not worked there previously) and or consideration involved.
Also, my company currently laid off over 50% of the staff and did not enforce non-compete agreements. Does this non-enforcement give set a precedent and thus making my non-compete invalid?
