My husband was laid off from his job last month and he applied for unemployment.
When he filed he was sent a letter that said he owed them money from overpayment of benefits from 1989 and that they would take 25% of his checks until it was satisfied.
We were not aware that he owed them any money, he had never been contacted about it.
Anyway we were ok with the 25% but when his first check didn't come like it was supposed to, he called and was told that they were going to keep 100% of his checks until it was paid for and also put him on a 16 week penalty. So he won't be able to collect anything at all for the next 4 months even if we were able to pay the balance in full, which of course we can't.
Also they told him that if he got a job they would garnish his wages to get their money.
He was told by the person on the phone that he would not be able to appeal this until all of the money was paid.
They also told him that they had tried to contact him but were unable to locate him.
We have filed income tax every year since then and also have only moved maybe 2 times, and he had also filed for benefits since then and just never collected because he always found a new job right away. So there is no way that they couldn't have known where he was.
Is there any kind of statute of limitations on something like this, or can they try and collect indefinitely?
