If we pay an employee for working their lunch hour, are there any possible legal ramifications by the employee, if we do not get a written statement saying they worked voluntarily.

Although you would not be in violation of the Federal law that says you must pay employees for all time worked, you would be in violation of the Tennessee law which requires you to give a 30 minute unpaid break to any employee working six hours or more. This is the case regardless of whether you get a signed statement from the insured or not.

*** Yes. TN state law [Title 50-2-103 (d)] requires that each employee scheduled to work six (6) consecutive hours must have a thirty (30) minute meal or rest period, except in workplace environments that by their nature of business provides for ample opportunity to rest or take an appropriate break.

If the employees timesheet or pay stub shows him/her working more than 6 hours without a break, he/she COULD claim that a meal break was not provided. It would be possible that you would have to defend yourself if that happened.
