I am a Virginia Computer Company Employee
that just sold my "division" to another PC company

approx 10 people were "sold"

the company will pay back wages ...
the company is 70+ people and will do cobra

i was supposed to sign a "non compete" when i joined
but no one asked me ... later while still under evaluation i
postponed signing one ... they forgot and i never did
during the 10+ months i was there

they tried to get me to sign one the last 5 days of employment
and sold company today without my signing ...
i MAY sign one with new employer who said he will hire us all
we meet tomorrow for first time

old employer called today and said that they had sold company
with declaration that i had signed and that if i did not
then they would not give me my vacation pay
which i had percieved as being "earned"

you get 1.2 days vacation per month i now have 120+ hours due me

can they refuse to give me my 3 weeks vactaion

that showed each pay period on my stub

i dont beleieve that i ever signed anything that acknowledged
that vacation was a "privledge'

can they intimidate me into signing this agreement to get back paid vacation

its 1500+ and it would probably take that much to fight it

unless a laywer would be able to charge for his expenses

need answers now

Virgnia has no law that requires the payment of vacation upon termination of employment. Therefore if they wish to make paying this to you conditional upon signing the agreement, they may.
