Payback commission in texas?

i started working for a company and signed contracts. 3 weeks later they were bought out and we were rehired with no contracts/paperwork with the new company. they continued to pay me my "salary", which is actually supposed to be a draw against commissions with no base salary according to the 1st company that hired me. however, i have no written or verbal agreements with new employer and my check stubs state "salary". i am planning to put my 2 - weeks notice in and would like to know if they can legally ask me to pay back the "commissions". i have not earned what i was paid although i have booked sales for the future.
