my former employer is holding my last day pay (i have already put in the hours). this is being done for my not giving a two week notice in writing (i did so verbally). in any event is it legal for the employeer to keep the last day's pay?

No, absolutely not. There are no circumstances whatsoever in which an employer can legally hold an employee's pay for hours already worked. (However, they are not required to pay you for your notice period if you give notice and they don't have you work it out.)

You can file a complaint with the state DOL.
