possible termination

My son works for a large retail home supply company. He worked on the night crew for a couple of months and then transferred to the day shift. Within the past several days, five of the seven people who worked on the night crew have been arrested and fired for theft. Some of them were still working on the night crew. He doesn't know if this was supposedly going on while he was there or if it just happened recently. Yesterday and today are his days off. Several of the employees have called to tell him they (management) are saying there are two left to go. He was surprised by the termination of a couple of the people who were fired. He did not take anything nor did he know about anyone else taking anything. He is afraid that everyone who worked on the night crew is going to be terminated. What should he do? Does he go to them first, or wait for them to call him in? If his is terminated and or arrested, would he have grounds to sue them? We live in California. Please help us now. We all know that innocent people are arrested everyday.

If the police try to talk to your son, tell your son to ask for a lawyer, even if he is not guilty of anything. If management talks to him, tell him to say that he doesn't know anything about any of it, period. Tell your son to make sure that if he is arrested, he SAYS NOTHING! Tell him not to answer ANY of their questions. He is to ask to talk to a lawyer. You should call one now just in case and perhaps have him standing by and tell him to accept any collect call from your son (police stations will only allow you to make collect calls). Get the lawyer's card and have your son carry it with him. Unless they have proof, it will be a "he said, he said," situation. As for being terminated from the job, unfortunately, your son is at-will and can be terminated for any reason or no reason.
