I went to an interview with Albertson's for prevent specialist.
The interview went great. After I was filling out a bunch paper work, which includes
Drug screening and background check agreements. Their also was one form, that
The interviewer told me it stated, that if I passed the 2 screening I was promised to sit down
And get a job offer.

After the interview, I went to get the drug-screening test.
The interviewer told me they would contact me the follow week and let me know.
It has been also 2 weeks and no contact.

I finally got a call on Monday from the Albertson medical lab telling me I was positive on something. She asked if I was on medication. I told her I was, she took down the drug and asked if I was prescribed this. I said yes, gave her my doctor’s information and the prescription number. She told me after this, it should be cleared up and I should call the person that was going to hire me.

In the pass about 6 or 7 years ago, I had 2 convictions. They both were misdemeanor and where both expunged. On the job application, it asked if I was ever convicted of a crime. It specifically stated, convictions that have passed 3 years or been expunged does not need to be revealed.

My question:
Is it possible to dig up my old conviction and use that on the basis of not hiring me?

If I pass the drug screening, and pass the background check? And they do not hire or sit down to offer me a job is that a breach of contract? It was orally and written that they would. Can I sue them or what can I do?

I have waited 2 weeks, left many messages to the interviewer, but no return call. I received the call from the medical lab on Monday this week. I planning to give it more time, but this is taking too long for a answer of yes or no that they would hire me.

If there is no contract why did i have to sign a paper. She explain to me what I was signing. 3rd, I did pass the drug test, it just soem prescribation that i was taking that casue the positive test. It was however cleared up by the medical lab.

Finally, Arent't they still required to give me and yes or no. At least state the reason why I was not hire by mail or phone call?

While it would be nice if the law said otherwise, no, they have no legal obligation to get back to you with a definite yes or no. If they don't get back to you with a yes, it's safe to assume it's no.

With limited exceptions which do not apply here, they have no legal obligation to give you a reason why you were not hired.

If there is no contract why did i have to sign a paper. There are all sorts of forms and papers that are typically signed as part of the recruiting or employment process. That doesn't mean that any of them are contracts.

According to you the form you signed said that IF you passed the two screens, they'd make you an offer. Apparently you didn't pass. The drug screen may have been ok but not the background check. I can certainly imagine a retail establishment being leery of hiring someone in a loss control position who had prior criminal convictions.
