The outcome of the investigation is irrelevent. If the ignorant comments do not occur again, then HR has done their duty. If it continues, you can file a complaint with the EEOC, which would be a protected action. Complaining to HR would also be protected, if you could prove that this complaint was the only reason you were terminated. The 3 strikes you already have could be an issue though.

If you are asking whether, in the event that you come forward, you are thereby bullet proof and cannot be fired for any reason, the answer is no. You cannot be fired for reporting an illegal action, but even after you report an illegal action you can still be fired for a validated misconduct reason, which includes an additional absences or tardy when you already have three strikes.
