I was out on FMLA leave for 12 weeks. My employer terminated me at the end of the 12 weeks, but I did not know it. I found out from a 3rd party, a finance company where I applied for a loan. Is this legal in Florida? I called my boss the day of the end of FMLA and told him the doctor would not release me to go to work. The boss asked me how long I would be out due to the surgery I have to have, and I asked if my job was in jeapordy, and he said no. A week later, I find out from a financial institution verifying employment that I had been terminated.

Yes, I realize the legality of the termination, it was just the way I found out about it. I found out from a third party, that is the part I was really asking about. I feel I would not have known about my termination if I had not found out from a third party. My disability is ongoing; I cannot return to any kind of work at this time.

Yes, surprisingly enough, your employer has no legal obligation to let you know you have been terminated. It was perfectly legal for you to be notified by a third party.
