I have worked for a company for almost two years. January 7th is my anniversary date. Vacation time is accrued - we earn one day at the end of each month we work for a total of ten vacation days.

At least two months ago I scheduled and had approved four vacation days for the month of December: 12/5, 12/11, 12/12 and 12/15.

On Wednesday, November 26th, I gave three weeks' notice to my employers. I told them my last day would be 12/16. They came back to me a couple of hours later and told me that my last day would be 12/4 and that I would still be paid for holidays up until that date (not vacation).

Am I entitled to vacation pay for those four days?

Senior Member
New Jersey has no statute that requires employers to pay for earned but unused vacation upon separation. It's entirely a matter of company policy.
